It gives you the right to vote, to work in any European Union country without a permit, to hold a Spanish passport and to stay in Spain without ever having to renew a residence card again. The process is demanding but predictable, and knowing the requirements in advance makes it much easier to prepare a complete application.

The main ways to acquire nationality

Spanish nationality can be acquired in several ways. The most common for foreign residents is nationality by residence, which is granted after living in Spain legally for a minimum period. Other routes exist for people born in Spain, for the children and grandchildren of Spaniards, for spouses of Spanish citizens and for specific historical situations. The right route depends on your personal history, so it is worth confirming which one applies before you begin.

How many years of residence are required?

The general rule is ten years of legal residence. Shorter periods apply to certain groups:

Five years for people who have been recognised as refugees.

Two years for nationals of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea and Portugal.

One year in specific cases, such as people born in Spain, people married to a Spanish citizen for at least one year and living together, and some widows and widowers.

In every case the residence must be legal, continuous and immediately before the application. Long periods outside Spain or gaps between permits can interrupt the count, so check your dates carefully.

Other requirements

Besides residence, you must show good civic conduct. This is checked through criminal record certificates and other documents, and a clean record is expected. You must also demonstrate integration into Spanish society through two official tests organised by the Instituto Cervantes.

The first is the DELE A2 Spanish language exam. People whose country of origin has Spanish as an official language, and some people who studied in Spain, are usually exempt. The second is the CCSE test on the Spanish Constitution and socio-cultural knowledge, which has 25 multiple-choice questions and is usually passed with a well-prepared study plan. Both certificates are generally accepted long after the exam date, so you can take them early, before you have finished collecting the rest of your file.

Documents for the application

Valid passport and residence card, plus full copies.

Birth certificate, apostilled or legalised and translated when required.

Criminal record certificates from your country of origin and any other country where you lived.

Spanish criminal record certificate.

DELE A2 and CCSE certificates when applicable.

Marriage certificate and documents about children, when relevant to your route.

Proof of payment of the administrative fee.

The process step by step

Confirm the residence period that applies to you and check that it is unbroken.

Book and pass the language and constitutional tests, if you need them.

Collect and legalise the documents, allowing time for foreign authorities.

Submit the application through the electronic office of the Ministry of Justice and pay the fee.

Wait for the resolution and answer any request for additional information.

Once approved, take the oath or promise of loyalty to the King and of obedience to the Constitution and the laws within the deadline given, and register your nationality in the Civil Registry.

Renouncing your previous nationality

At the oath, most applicants must renounce their previous nationality. There is an important exception for nationals of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea and Portugal, who can keep their original nationality. Check the rules of your country of origin as well, because some states do not allow dual nationality or have their own procedures.

How long does it take?

The law sets a maximum period of one year for the administration to decide, but in practice many files take longer. Delays often come from incomplete documents or from requests for corrections, so a well-prepared application is your best protection against long waits. Keep your contact details up to date, because notifications are sent electronically and deadlines start running quickly.

Preparing for the two exams

The DELE A2 is a basic level exam, so most people who use Spanish in daily life can pass it with some focused practice on reading, writing, listening and speaking. For the CCSE, the Instituto Cervantes publishes the official study material, which covers government and legislation, rights and duties, culture, history and geography, and society. Reading it several times and practising with sample questions is usually enough.

Special situations

Recent laws created additional routes for some descendants of Spaniards who left the country, and other historical situations may also apply. If a parent or grandparent was Spanish, do not assume that you must wait ten years. A short review of your family documents can show whether a faster route is open to you.

Practical tips

Start collecting documents early, because apostilles and translations take time. Keep copies of everything you submit, and check your electronic mailbox regularly. If your file is refused, read the reasons carefully: some problems can be corrected with a new application, and others can be challenged through an appeal.

Our team can review your dates, check whether you qualify for a shorter residence period and prepare the whole application with you, from the exams to the oath.

This article is general information and not legal advice.
